1. Acceptance of Terms

Welcome to Iridium Trends ("Service", "we", "us", or "our"). By accessing or using our service at iridiumtrends.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and Iridium Trends. Please read them carefully before using our Service.

2. Description of Service

Iridium Trends is a content research platform that helps video creators discover data-backed ideas for their next videos. Our Service analyzes publicly available content across social platforms to identify trending topics and successful content patterns in your specific niche.

The Service delivers personalized idea playbooks that include a detailed breakdown, step-by-step execution strategy, proof-of-concept videos, and key insights to help creators decide whether to turn an idea into a video.

3. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

4. Account Registration

Account Creation

To access certain features of the Service, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

Account Security

You are responsible for maintaining the confidentiality of your account credentials. We are not liable for any loss or damage arising from your failure to protect your account information. You agree to notify us immediately at support@iridiumtrends.com if you suspect any unauthorized access to your account.

5. Subscription Plans and Billing

Free Trial

We offer a free trial that includes your first profile creation and a 30-day trial period to test the Service. No payment information is required for the initial profile creation, however a credit card is required to start the trial. After the 30-day trial period ends, you must subscribe to a paid plan to continue using the Service.

Subscription Plans

We offer three subscription tiers:

  • Rookie: $9/month - 50 ideas per month
  • Pro: $19/month - 125 ideas per month
  • Legend: $39/month - 300 ideas per month

All plans include access to the complete feature set. The only difference between plans is the number of ideas you can receive each month.

Billing and Payment

By subscribing to a paid plan, you agree to pay the applicable subscription fees. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

You authorize us to charge your payment method on a recurring basis for your subscription fees. If your payment fails, we may suspend or terminate your access to the Service until payment is received.

All fees are non-refundable except as required by law or as explicitly stated in these Terms. We reserve the right to change our pricing at any time, but price changes will not affect your current billing period.

Plan Changes

You may upgrade or downgrade your subscription plan at any time. Upgrades take effect immediately, and you will be charged a prorated amount for the remainder of your billing period. Downgrades take effect at the start of your next billing period.

Cancellation

You may cancel your subscription at any time. Upon cancellation, you will continue to have access to the Service through the end of your current billing period. No refunds will be issued for partial billing periods. After your subscription ends, you will lose access to paid features.

6. Acceptable Use

Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree to use the Service to research and create original content, and not to engage in any activities that violate these Terms or applicable laws.

Prohibited Activities

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Share your account credentials with others or allow others to access your account
  • Attempt to reverse engineer, decompile, or disassemble any aspect of the Service
  • Use automated tools (bots, scrapers, etc.) to access or collect data from the Service
  • Interfere with or disrupt the Service or servers connected to the Service
  • Attempt to gain unauthorized access to any part of the Service
  • Remove, circumvent, or disable any security features or access restrictions
  • Use the Service to harass, abuse, or harm another person or entity
  • Distribute malware, viruses, or any other harmful code
  • Resell, redistribute, or make the Service available to third parties without our permission
  • Use the Service in a way that could damage our reputation or business

7. Intellectual Property Rights

Our Intellectual Property

The Service, including its original content, features, functionality, software, and design, is owned by Iridium Trends and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

Your Content

You retain all rights to the niche descriptions, goals, preferences, and other information you provide to the Service ("Your Content"). By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process Your Content solely for the purpose of providing and improving the Service.

You represent and warrant that you own or have the necessary rights to Your Content and that Your Content does not violate any third-party rights or applicable laws.

Generated Idea Playbooks

The idea playbooks generated by our Service are provided to you for your personal or commercial use in creating content. While you may use these ideas to create your own content, you acknowledge that the underlying data, algorithms, and analysis methods used to generate these ideas remain our intellectual property.

8. Third-Party Content and Links

Our Service analyzes and references publicly available content from third-party platforms including YouTube, TikTok, and Instagram. We do not own or control this third-party content and are not responsible for its accuracy, legality, or appropriateness.

The Service may contain links to third-party websites or services. We are not responsible for the content or practices of these third parties. Your use of third-party websites is at your own risk and subject to their terms and conditions.

9. Disclaimers and Limitations of Liability

Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected. We do not guarantee the accuracy, completeness, or usefulness of any information provided through the Service.

No Guarantee of Results

While our Service provides data-backed insights and recommendations, we make no guarantees about the performance or success of content you create based on our ideas. Your results depend on many factors beyond our control, including your execution, audience, timing, and platform algorithms.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IRIDIUM TRENDS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers or your personal information
  • Any bugs, viruses, or other harmful code transmitted through the Service
  • Any errors or omissions in content or data provided through the Service
  • Any content obtained from the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Iridium Trends and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any rights of another party, or (d) Your Content.

11. Data and Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

12. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service. We may also impose limits on certain features or restrict your access to parts or all of the Service without notice or liability.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

  • Posting the updated Terms on this page
  • Updating the "Effective Date" at the top of these Terms
  • Sending you an email notification (for material changes)

Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service and cancel your subscription.

14. Termination

Termination by You

You may terminate your account at any time by canceling your subscription through your account settings or by contacting us at support@iridiumtrends.com. Upon termination, your access to the Service will continue until the end of your current billing period.

Termination by Us

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Failure to pay subscription fees
  • Extended periods of inactivity
  • At our sole discretion to protect the Service or other users

Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and all associated data, including Your Content and generated ideas. Sections of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

15. Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Dispute Resolution

In the event of any dispute arising from or relating to these Terms or the Service, you agree to first contact us at legal@iridiumtrends.com to attempt to resolve the dispute informally.

If we cannot resolve the dispute within thirty (30) days, either party may pursue formal legal action. You agree that any legal action or proceeding shall be brought exclusively in the federal or state courts located in the United States, and you consent to the jurisdiction of such courts.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.

16. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Iridium Trends regarding the Service and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid or unenforceable provision will be deemed modified to the minimum extent necessary to make it valid and enforceable.

Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver of any provision will be effective only if in writing and signed by an authorized representative of Iridium Trends.

Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section shall be void.

Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or internet service failures.
